Terms of Service

1. Acceptance of Terms

By accessing or using the TickAtlas API ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including developers, traders, and organizations accessing the API.

2. Description of Service

TickAtlas provides a REST API delivering real-time financial indicators, OHLCV data, trading signals, and AI-powered market analysis. The Service includes access to 42 technical indicators across 7 timeframes, documentation, client libraries, and a user dashboard.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your API keys and account credentials. You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. API Usage & Rate Limits

Your use of the API is subject to the rate limits and quotas of your subscription plan. Exceeding rate limits may result in throttled responses (HTTP 429). Automated systems must implement proper backoff strategies. Abuse of the API, including denial-of-service attempts, will result in immediate account suspension.

5. Acceptable Use

You may use the Service for lawful purposes only. You agree not to:

• Resell or redistribute raw API data without authorization
• Attempt to reverse-engineer, decompile, or derive source code from the Service
• Use the Service to engage in market manipulation or illegal trading activities
• Share API keys or allow unauthorized access to your account
• Circumvent rate limits or security measures

6. Payment & Billing

Paid plans are billed in advance on a monthly or annual basis. Pay-As-You-Go usage is billed based on actual consumption. All fees are non-refundable unless otherwise stated. We reserve the right to change pricing with 30 days' notice.

7. Data Accuracy Disclaimer

Financial data is provided "as-is" and should not be considered investment advice. While we strive for accuracy and timeliness, we do not guarantee that data is error-free, complete, or suitable for any particular trading strategy. Users are solely responsible for their trading decisions.

8. Limitation of Liability

To the maximum extent permitted by law, TickAtlas shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or trading losses, resulting from your use of the Service.

9. Service Level Agreement

Enterprise plan customers receive a 99.9% uptime SLA. SLA details and credit policies are outlined in the Enterprise agreement. Standard plans do not include an SLA but target 99.5% uptime.

10. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your access immediately for violation of these Terms. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or dashboard notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance.
